Welcome to the indigenous-peoples.org website (the “Site”) provided by the Anne Marie Deruyttere Indigenous Peoples Foundation (“we” or “our” or “us”). This Privacy Policy applies to the access and use of our Site by visitors and donors, and describes the types of information we collect from our Site or that you provide to us through other means, how we may use that information, to whom and under what circumstances we may disclose it, and how we protect it. By using this Site or voluntarily providing personal information to us, you consent to the terms of this Privacy Policy. If you do not agree to the policy, please do not use the Site.
 
1. Collection of Personal Information from Site Users 
 
Information Collected Automatically
 
Each time you visit the Site, we may automatically collect certain types of information. Some examples of automatic information we may collect are as follows:
 
  • Your IP address, MAC address, browser type, operating system, device-identifying information, type of computer, and type of Web browser software, the specific webpages visited during your connection, and the domain name from which you accessed the Site.
  • Information about your browsing behavior, such as the date and time you visit the Site, the areas or pages of the Site that you visit, the amount of time you spend viewing the Site, the number of times you return to the Site and other clickstream data.

  • Sign up to receive a newsletter or email communications from us;
  • Register for or attend one of our events;
  • Correspond or communicate with us by phone, e-mail or otherwise;
  • Complete a survey; or
  • Use social media to interact with us, or to share something from our Site with others, we will receive information about what you share and other details that may be based on your social media privacy settings.
 
2. Use of Personal Data Collected
 
We may use information about you for purposes described in this Privacy Policy or disclosed to you on the Site. For example, we may use information about you: 
  • To process a donation;
  • For editorial and feedback purposes;
  • For marketing and promotional purposes;
  • To create a statistical analysis of users’ behavior;
  • For content improvement;
  • To customize the content and layout of the Site;
  • To notify you about updates to the Site;
  • To respond to your inquiries;
  • To post your comments or statements on any blog or other online forum maintained on our Site; or 
  • To take other actions in response to your inquiries or other website activities.
 
3. Sharing or Disclosure of Your Personal Data
 
Unless otherwise agreed, we will not sell or disclose to third parties any individually identifying information, such as names, postal and e-mail addresses, telephone numbers, and other personal information which users voluntarily provide to us, except as follows:
  • We work with business partners who support us, such as companies who plan and assist with registration for our events. We also use outside service providers to facilitate the Site and overall operation, and to perform functions on our behalf, such as monitoring visitors to our Site, sending postal mail and email, removing repetitive information from donor lists, analyzing data, processing credit card payments and providing customer service. These third parties may have access to your personal information as needed to perform their functions, but they may not use it for any other purpose.
  • To the extent necessary to comply with applicable laws or valid legal processes, such as in response to subpoenas or court orders.
  • To protect the rights and intellectual property of the Anne Marie Deruyttere Indigenous Peoples Foundation.
  • To investigate, prevent or take action regarding illegal activities, suspected fraud, violations of our policies, or as otherwise required by law.
  • In urgent circumstances to protect the Anne Marie Deruyttere Indigenous Peoples Foundation or the personal safety of any individual.

6. Data Security
 
We use industry-standard techniques on the Site to help to protect any personal information you have provided to us from loss, misuse or alteration. However, please be aware that no method of electronic storage can ever be 100% secure. Therefore as is the case with any organization, we are not in a position to guarantee the absolute security of your information. In this regard, we urge you to take every precaution to protect your personal data while you are on the Internet. At a minimum, we encourage you to make sure that you are using a secure browser as you surf the Internet.
 
7. Social Media
 
We maintain a social media presence, such as a Facebook page. You can interact with us through social media, such as by posting content, sharing material from our Site, and using our social media plug-ins. When you interact with us using social media, we may receive information such as your user ID, your profile picture, photos you post, and similar information, which is often determined by your privacy settings at social media sites. We may use the information for the same types of purposes we describe throughout this Privacy Policy. Your use of social media sites is primarily governed by the site operators’ privacy policies and terms of service, and the information you share with us and with others is largely controlled by the privacy settings you have established at those sites.
 
8. Children’s Privacy 

Under Age 13
Our Site is not specifically directed toward children, and we do not knowingly collect personal information from persons under the age of 13 on our Site without verifiable parental consent. If we learn that a child under the age of 13 has submitted personally identifiable information online without parental consent, we will take all reasonable measures to delete such information from our databases and to not use such information for any purpose (except where necessary to protect the safety of the child or others as required or allowed by law). Under Age 18
Minors under 18 years of age may have the Personal Information that they provide to us through the Site deleted by sending an email to hello@indigenous-peoples.org requesting deletion. Please note that, while we make reasonable efforts to comply with such requests, deletion of your personal information does not ensure complete and comprehensive removal of that data from all systems.
 
9. Do Not Track
 
Do Not Track (DNT) is a privacy preference that users can set in some web browsers, allowing users to opt out of tracking by websites and online services. At the present time, the World Wide Web Consortium (W3C) has not yet established universal standards for recognizable DNT signals and therefore, the Anne Marie Deruyttere Indigenous Peoples Foundation and the Site do not recognize DNT.
 
10. Your California Privacy Rights
 
California residents who provide personal information in obtaining products or services for personal, family, or household use are entitled to request and obtain from us once a calendar year information about the customer information we shared with third parties for their own direct marketing purposes, including the categories of information and the names and addresses of those businesses with which we have shared such information. As discussed elsewhere in this Privacy Policy, we do not currently share the personal information of California residents with third parties for their own direct marketing purposes. However, if you have further questions about our privacy practices and compliance with California law, please contact us as explained below.
 
11. Your European Privacy Rights 
 
If you are a European resident, to the extent that you reside in Europe (only), you have certain rights in relation to your personal information under the applicable European data privacy laws. This European Privacy Rights section only applies to such individuals. Once any such individuals come to the US, this section no longer applies to any additional personal information provided about them to us. Under applicable European data privacy laws, we are the data controller.
 
(a) Rights to control your personal information
Applicable European data privacy laws gives certain individuals the right to access their personal information. Your right of access can be exercised in accordance with the European data privacy laws. If you would like to request a copy of your personal information being held by us, or request that it is deleted or to update and/or correct your personal information or request that we provide a copy to another data controller of your personal information that you have provided to us, please contact us. We will need enough information to ascertain your identity as well as the nature of your request. We will aim to respond to your request within one calendar month of receipt of the request. Where we were unable to do so within the calendar month, we will notify you of the soonest practicable time within which we can respond to your request (and within three months from the date of your request). There are certain exemptions and restrictions of these rights under the European data privacy laws that enable personal information to be retained, processed or withheld from access and we will inform you of these if applicable. We use your personal information for the following key purposes: 
  •  to contact you: subject to applicable law, we and/or our third-party service and business providers may contact you and send you communications relating to your donation or the Foundation. Where required under applicable data privacy laws, we will not send you marketing communications without your prior consent;
  • for legal purposes: we may use and share personal information for legal purposes, including financial, regulatory, tax and other legal obligations and to respond to governmental or regulatory requests or subpoenas or for litigation purposes;
  • for our legitimate interests and those of a third party: we may use your personal information to manage our legal, regulatory, financial and business requirements, including obtaining legal advice, in the course of disputes and litigation, internal and/or regulatory investigations and other legitimate interests;
  • for our business purposes: we may use your personal information to help us manage the lawful requirements of our business; 
  • for other purposes: subject to applicable law, we may use your personal information for additional purposes in connection with the website or our organization, where you have provided your prior consent.
 
(b) International transfers
 The Site is governed by and operated in, and in accordance with the laws of, the United States. If you are located outside of the United States, please be aware that information we collect is transferred to and processed in the United States. By using the Site, or providing us with any information, you (a) acknowledge that the Site is subject to the laws of the United States, (b) consent to the collection, processing, maintenance and transfer of such information in and to the United States in which the privacy laws may not be as comprehensive as or equivalent to those in the country where you reside and/or are a citizen, and (c) waive any claims that may arise under those laws.
 
(c) Sharing your personal information We share your personal information with third parties to help us use your personal information, as described in the Privacy Policy and in addition, we may need to share your personal information with our professional tax, legal, audit or financial advisors. We may also share your personal information when we receive requests for information in the context of legal disputes, investigations regulatory enquiries or similar requests.
 
(d) Retention of personal information We will only retain your personal information for as long as reasonably necessary to fulfil the purposes we collected it for, including for the purposes of satisfying any legal requirements. To determine the appropriate retention period, we consider the amount, nature and sensitivity of the personal information, the potential risk of harm from unauthorized use or disclosure of your personal information, the purposes for which we process your personal information and whether we can achieve those purposes through other means, and applicable legal requirements.
 
(e) Complaint process
If you have any concerns regarding how we are handling your personal information, please contact us. We will strive to deal with your concerns promptly. If you wish to complain about the handling of your personal information outside of the Anne Marie Deruyttere Indigenous Peoples Foundation, you have the right to raise a complaint with a supervisory authority in your country of residence under European data privacy laws.
 
12. Changes to this Privacy Policy
We may change this privacy policy from time to time, including as required to keep current with rules and regulations, new technologies and security standards. When we do, we will post the change(s) on our website. If we change the policy in a material and retroactive manner, we will provide appropriate notice to you.
